Terms and Conditions

 

These terms and conditions apply to all agreements between the consumer and Amore For You and for all products of Amore For You that the consumer purchases. These conditions are available at all times on the Amore For You website.

Article 2 – Supply of products

The following general terms and conditions of Amore For You apply to all products. The conditions are accessible to everyone and included on our website www.amoreforyou.com.

 

Each offer contains information that it is clear to the consumer / buyer what rights and obligations are attached to the acceptance of the offer. This concerns in particular: the price including taxes, any costs of delivery, the manner in which the agreement will be concluded and which actions are necessary for this, the non-application of the right of withdrawal, the method of payment, delivery or execution of the agreement.

Article 3– Personal information

When entering into an agreement, the consumer is obliged to provide his or her personal data correctly and truthfully to Amore For You. The consumer must check the specified Personal Data before confirming the conclusion of the agreement. The consumer must carefully handle the log-in data that Amore For You provides to the consumer in order to gain access to an account on the website. The login details are not transferable. The consumer is obliged to observe complete confidentiality with regard to the login details and will keep the login details in a safe place. If it appears that information provided by you is incorrect or incomplete, Amore For You reserves the right to terminate your registration and to refuse further access to the site.

 

Article 4 – Pricing of products

The prices of the offered products and / or services mentioned in the offer can be adjusted. However, closed agreements are executed for the price stated in the web shop. Obvious mistakes or errors in the offer do not bind the organization. The prices mentioned in the range of products or services are inclusive of VAT and excluding shipping costs as indicated in the web shop.

Article 5 – Delivery of products

Amore For You works together with external distributors for the delivery of products and / or services. The delivery conditions are therefore in line with those of these parties. The delivery is made to an address or shop in or outside the Netherlands, as indicated in your order. We offer different delivery options, but we are not liable for any delay in delivery, or undelivered products if the delay or failure to deliver is wholly or partially caused by circumstances beyond our control. When you place an order, keep in mind that we cannot deliver on national holidays and that orders placed on such days or during busy periods can take longer to be delivered. The expected delivery date is confirmed when you complete the order. There may be problems with the delivery of residential products through certain delivery services and at certain points. If we cannot deliver your order using the delivery method you have selected and / or to the delivery address chosen by you, we will contact you to offer alternative options.

Article 6 – Delivery costs

The prices for the offered products and / or services are in euros, including VAT, ticket and excluding € 6.95 delivery costs per address in the Netherlands and € 9.95 for other countries in the E.U. For all other continents, we charge shipping costs of € 19.95.

 

Article 7– Placing an order at Amore For You

Amore For You aims to process your order data (partially) automatically and takes these data unchanged to its database. Amore For You can not be held responsible for errors in delivery data and / or text cards as specified by the consumer. If you request Amore For You to manually adjust an order, Amore For You will not be responsible for these modifications. Such requests for adjustment can be considered as executed after Amore For You has informed you about this.

 

Article 8– Agreements between the customer and Amore For You

An agreement is only completed after you have agreed for the order and payment and / or when Amore For You has received an (electronic) agreement. Amore For You reserves the right to (temporarily) not execute an order until payment has been made.


 

Article 9– Payment

You are obliged to pay after you have made an order with Amore For You Payment must be made by return, except when ordered on an invoice basis. The latter payment method is only possible for companies with a valid chamber of commerce number that have received approval. The payment term for orders made on invoice basis is within 14 days. If the payment is not paid by return and if the invoice has not been credited to our bank account after the due date, this will have the following consequences; the customer receives an (electronic) reminder in which a last opportunity is offered to pay the bill. If Amore For You is obliged to hand over the claim for debt collection, all extrajudicial and judicial collection costs will be borne by the customer.

 

If the consumer / buyer has accepted the offer electronically, the company will immediately confirm electronically the receipt of the acceptance of the offer.

If the agreement is created electronically, the company will take appropriate technical and organizational measures to secure the electronic transfer of data and he will ensure a secure web environment. If the consumer / customer can pay electronically, the company will take appropriate security measures.

 

The organization can - within statutory frameworks - inform whether the consumer / buyer can meet his payment obligations, or have paid them, as well as all those facts and factors that are important for a responsible conclusion of the distance contract. If the company on the basis of this investigation has good reasons not to enter into the agreement, he is entitled to refuse an order or request motivated or to attach special conditions to the execution.

Article 10– Delivery process and return

Amore For You strives to deliver the order properly. Exceeding this delivery period does not entitle you to compensation or the right to cancel the order or to dissolve the agreement. For the main product, flowers and plants, returns are not possible because they are subject to decay.

Article 11– Holidays

No order processing on Saturdays, Sundays and / or holidays; your orders will only be processed the next business day. Take this into account. If you nevertheless submit orders on a Saturday, Sunday and / or holiday, Amore For You will process this order on the next working day.

 

Article 12– Delivery at companies and hospitals etc.

Deliveries in hospitals, care homes, hotels, restaurants, campsites, offices, etc. are completely at your own expense and risk, since the organizations in question have their own internal procedures with regard to purchase orders.

 

Article 13– Warranty and liability

Should breakage or loss occur during transport, Amore For You will ensure that a new product is delivered to you as soon as possible, provided that you have reported this on receipt of the product, have specified the defect and stated on the packing slip. If you do not do this, you will not be entitled to a replacement product and / or compensation of any kind in any case.

 

If force majeure cannot be delivered in accordance with the agreement, Amore For You will inform you as soon as possible by telephone, fax and / or email, without being obliged to pay any damages. In case of force majeure, Amore For You can terminate the contract or suspend the delivery until the moment that the force majeure situation ceases to exist, in consultation with you. Amore For You will reimburse the amount paid in the event of cancellation of the agreement due to force majeure. Force majeure considered below are the following and similar circumstances: a) restrictive measures by the government; b) total or partial strike or failure in the internal and external transport device; c) riots and other irregularities that prevent timely execution of the agreement; d) total or partial stagnation in the production equipment of, or strikes or exclusions in, the company or in the goods of which goods or raw materials or products are involved.

 

Because flowers are fresh products, Amore For You can not offer a cooling-off period in which you can dissolve the agreement without giving any reason after receiving the relevant bouquet and / or related (fresh) product. The bouquets may differ slightly from the photos because other flowers are taken over the year. For the main product flowers and plants, returns are not possible because they are subject to decay.

 

Article 14– Liability

Amore For You can not be held liable for the information given on its site (s). The information is given for informational purposes only. Amore For You can in no way accept liability for completeness, text and typing errors and other inaccuracies that may occur on this site. Amore For You can not be held liable for any consequences arising from the use of products and / or services that are described and / or offered on this site.

Article 15– Discounts

Discounts do not apply to the delivery costs and / or in combination with other offers.

 

Article 14– The Dutch Law

Dutch law applies to these terms and conditions. Any disputes that may arise as a result of these conditions or in connection with agreements that may result from this will in the first instance be exclusively submitted to the competent judge in Leiden, unless explicitly otherwise agreed.

 

Article 17– Complaints procedure

Of course, we pay the utmost care to your order. So we find every complaint one too many. You can make your complaint known by sending a message to amoreforyou@outlook.com. Flower boxes can not be returned because they are subject to decay. Complaints handling with regard to the delivered product takes place when contact is received within two days of receipt. We would like to receive your story, explained with photos via the mail. You will receive a response from us regarding the handling of your complaint as soon as possible.
